Meeting With My Friends at Siam Paragon

I just returned from the meeting with my old friends at the Siam Paragon. The meeting was very nice and everyone enjoyed their Italian food a lot. Although I had many chances to try genuine Italian food when I was studying in Europe, I have to confess that I enjoy eating Thai-style-Italian food more than those European style that I ever tried in Europe. Not only because of cheaper price, but also the food equality, as well as taste, is much superior to those I tried in Europe. I will come to try them again next time with my girlfriend and my family. I hope they do like it.

Apart from having delicious foods, I had a chance to talk with my old friends. There were 8 people come to join the meeting. Sira and his girlfriend came first and are responsible for reserving the seats which were quite rare tonight. Then followed by Sira were Namkang, Me, Sasi-orn, Ann, Art and Methaya whom I never expected to meet before. Actually there should be another two more people, Tum and Win. However, they unfortunately called us last minute and said that they could not make it tonight because of their busy work this evening. They apologized us for their missing, and promised to join us in the next meeting.

I have to say that this is my first time since my graduation from Thammasat to spend time with my old friends; especially Namkang, Methaya and Sasi-orn. Time is running so fast. Everyone is growing and has his or her path of chosen life. This reminded me good old memories when we were students at Thammasat University, a place where our love and friendships have been formed and continue endlessly.

Sasi-orn has just come back from UK after her graduation on Master degree in Journal Study. Before taking her Master degree abroad, she spent her time working as a journalist with a several journals and newspaper; including the former Far Eastern Economic Review which was recently shut down last few years ago. She told us many interesting stories about her thesis which was about the sex industry in Thailand.

During her thesis writing, she came back to Thailand and did some field surveys to collect data that are necessary for her study. In doing so, she had to get into some nightclubs and bars to make interviews with the bar owners, business operators and prostitutes. Her findings are certainly interesting and produce profound feeling on the destiny of those prostitutes that getting involved in this business, and being brutally treated by business owners.

Besides Sasi-orn, I also met Methaya, or Non, who graduated her Ph.D. in Economics, majoring in Econometric, from Utah University last year. Now she is working as a senior manager at BOL, a private company which enjoys a concession licensed by the government to reproduce and sell to its subscribing members the information of business profile having been registered at the Office of Registration.

Actually I know her company before as my workplace is currently spending a huge budget to buy the company's service for being able to access the companies' profiles and their shareholders' information. I got her name card, and will ask for her special discount next time after the current one becomes expired. She also informed us her good news as she will be married next January with her boyfriend, Jeerasak, who is now a diplomat taking his position as a Secretary in the Thai Embassy's South Africa office. We wish her all the best with her family life in the future.

Life Is Going On

There was nothing much during past days, after my last entry to this blog. Still I have yet got any reply from the law firms where I droped my application. I hate this kind of feeling; a feeling of uncertainty. No matter how hard I try, I have not yet succeeded it. This is really beyond my control, and depends critically on the market demand. Such a feeling, being a loser, hampers my determination to apply for another job and to continue working on my existing work that I have to complete it by the end of this month.

I realize that to deal with this problem, and to strengthen my emotional feeling, I have first need to finish my assigning work as soon as possible. I can't spend more time with my grief for being a loser. My girlfriend many times argues that I am not such a loser because I have not yet put enough efforts to sending out the application to the remaining companies. Yesterday I thus spent part of my time searching for the website containing a list of law firms that I would direct my appliction to. The website's name is "Legal 500", and there are more than 50 registering law firms that operate cross-border transaction legal consulting services in Thailand, which interest me a lot. Life is going on, and I have to find way to overcome this existing difficulty by myself.

Today, apart from going to TDRI to search for some information, I will have an appointment with my old friends who were my classmate when I was studying at Thammasat. Sira called me last few days ago, and informed me that a meeting will take place at Vanila Industry Restaurant, Siam Paragon, at 7.00 pm sharp. I have never been there before, but hopefully I could find that place easily. I hope to see many of my friends over there and talk with them many interesting issues, including job opportunities existing in their workplace.

Law and Economics: New Acadamic Frontier in Thailand

Yesterday I had a good chance to talk with Khun Suchint, a founder of Baker&Mckenzie's Thailand Office, on several interesting issues. Actually, I was introduced to know him by my old friend who was my colleague at TDRI, and she is now becoming Khun Suchint's colleague and a lecturer at Mea Fah Luang University in Chiangrai Province.

Apart from his comments about my future employment, he also discussed with me about his self-interest on Economics. He said that he has many times urged someone he knows and teaches in law schools to place an importance of learning economics. He said that from now on, law students can no longer implement laws without a proper understanding of economic reasoning behind the case. He said that from this point of view, most of legal practitioners, especially judges, have many times failed to produce awards which sound commercially reasonable for both parties.

Although I have not yet had a chance to be a lawyer, I think I can understand his point. In my opinion, part of this problem is due to the fact that law practitioners in Thailand presently perceive law in a conventional way and accustom to thinking of rules of laws as tools for justice, or the provider of justice. They normally do not view law as incentives for changing behavior and as instruments for policy objectives that aiming for efficiency and distribution purpose. In this regard, economics, as a social science to understand human behaviors and their provoking incentives, is usually ignored by most of lawyers, including some law professors in the university.

If we accept the importance of law as a tool to effectively socialize our society, we have to accept that we can't solve the practical problems through the study of sensitivity of verbal distinctions only. Social problem is much more complicated than ever and can't simply be resolved through the mere understanding of legal text.

In the future, lawyers and economists should learn from each other. Legal practitioners might learn from economists by incorporating an economic analysis into their case. On the other hand, economists can learn techniques from lawyers about the verbal distinction which economists usually ignore, but seem to be important for them to draw the economic models which are closed to the reality.

Nowadays "Law and Economics Programme" becomes more popular and has been offered in many law schools; particularly in the US and EU. Not only have those law schools introduced this programme in their curriculum, but they also have produced law journals contributed consistantly by many famous academicians in this area. The advancement of the studies is apparently come along with the development of case complication which need more in-dept analysis on both law and economics study.

I can't help myself, but am thinking of when our university, especially Thai law schools in general, will place more importance of this apparently new area of study and mandatorily require our law students to study Economics as one of their compulsory courses, whilst taking their conventional legal study at school.

My Journey to the Downtown

I haven’t got into this blog since my last entry. Not because I was so lazy, or did not keep my words, but I got sick during last 3-4 days. However, in no cases should my life be suspended because of this excuse.

On last Friday I went to JETRO Business Center to search for the information that must be used for my part time job at TDRI. Prior to proceeding to JETRO, I made up my mind to drop my job application form at the law office somewhere on the Sathorn Road. I reached there nearly 12.00 am, so people were taking their lunch break. I directed to the information counter of that Law Office, and asked for the application form. She was so kind and gave me documents that I have to fill out carefully and completely.

The questions were amazing as many of them are about my personal information, which I had never been experienced before. For example, “Have you been engaged? And if yes, when will you get married?” or “How many children do you have? And by whom the children would be taken care of?” Although this type of questions looked so funny, one thing should be kept in mind is that a successful candidate will be required to entirely spend his time and best efforts for the success of the company, and its clients. Someone says that's life.

After filling out the application form and taking my lunch break at Mcdonald’s, I then proceeded to the JETRO Library which is located on the first floor of the Nattawan building where several Japanese’s non profit organizations are also located. Over there it looks like a small Japanese community located in the center of Bangkok.

The library contains a various collections of Japanese books which are all kept in good order. Although there are a large number of book collections stored in the library, all of them are in Japanese, even the library’s instructions. When I wanted to look for something, I always asked for an assistance of librarians to find out the exact books or research documents I really needed.

I was very impressed with their good hospitality and enthusiastic assistance. I think they work like Japanese people who treat everything seriously. They tried by all means to give me hands in clarifying things when I could not clearly understand the substance of the books or documents which merely appears in Japanese. Besides their hospitalities, I found out that they also have an excellent command in spoken Japanese and can fluently communicate with Japanese people who come to visit the library every day.

In my opinion, hiring Thais having good command in both Thai and Japanese is a very good idea. One of the main reasons is that Japanese investors, with the assistance of the local staffs, will be able to instantly keep up with the newly released information that is necessary for them to do business in Thailand.

After getting all I needed, I then returned back home immediately by a sky train from Siam Center Station. Perhaps because of bad pollution, I felt so bad and extremely exhausted; both mentally and physically. I couldn’t imagine how I could survive if I get my job over there. Maybe it might take me some more time to get used to it and learn how to live my life during a peak traffic jam in that area.

How long do I have to wait?

Nothing is happened with the result of my job application. After waiting for almost two weeks, I have made up my mind to look for another law firm company to drop my application form, providing that nothing is better next week.

Last night I talked to my friend who is currently working as a lawyer in one of the famous international law firms in Bangkok. He gave me some great comments and good recommendations, which can be summarized as follows;

Firstly, sometimes getting no response from the law firm for which we apply does not mean that we are disqualified or incapable, but probably because vacancy is not yet available at this moment, or the company's workloads are too minimal so that it is not worth for the company to hire an additional lawyer at the competitive wage rate.

Secondly, when submitting the application form, it should bear in mind that a lawyer is normally expected to contribute commensurately to the price he got paid. So it is quite essential that applicant be capable in doing multi-task job descriptions. So instead of solely focusing on your specific area of expertise, the applicant should rather put some more additional areas of specialization or any other areas in which the applicant might have keen interests. This might be of importance for the firm to take into account when assigning a job to a new recruiting staff.

Lastly, some Thai graduates believe that applying for a job at the highly competitive law firms is the most desirable thing to do. In fact, it is more advisable for them to begin with some local law firm which has a good mentoring system, offers them a good practice and give them an opportunity to learn and build up their confidentiality to work as team. This is very important and considered to be a key element leading to a career success in the future.

I feel much better with his advices, and learn from him many failures that he made when he was applying for a job. Thanks man.

TDRI's Mid-Year Conference 2006

Today I got up early this morning in order to attend the conference at the Imperial Queen's Park Hotel on 9.00 am. So being able to avoid the peak traffic jam in the rush hour in the morning, leaving the home early is thus the best strategy.

The conference's main topic was "The good corporate governance in private and public sector: a case stemming from the Shin's deal". The conference was organized by TDRI, under the collaboration with the faculty of Economics of Thammasat University. The conference was organized in one whole day and many people from both private and public sector also joined this conference.

In my opinion, the most highlighted was on the morning session as I learned the meaning of nominee under the current Thai Alien Business Law and the way in which Thai nominees have been constituted. Equally important, I also learned that the problem of nominee in Thailand becomes more acute as most of prohibited business activities in Thailand, stipulated by Thai Alien Business Law, are being indirectly controlled by foreign investors through their Thai nominees. One of the major reasons behind that they want to avoid the difficulties stipulated by Thai law. For example the restrictions upon land purchasing and share ownership in some foreign-prohibited activities; i.e. telecommunication industry, airline industry etc. Although nominee has been widely used among foreign investors, it is illegal per se under Article 36 of the Thai Alien Business Law.

It should be noted that apart from the problem of the Thai nominees being appointed by and acting on behalf of the foreign investors, the problem also includes the case where Thai investors appoint foreign investors in the overseas countries to be their nominees and reinvest in Thai Stock Market to manipulate the stock price. As illustrated by the presentation, a number of foreign investors presumed to be nominees of Thai investors and investing in Thai stock market become increasing, and invest so much their funds in a number of stocks having unattractive investment yields. This perverse action can potentially signify the attraction of foreign nominee in Thai stock market and the increasing trend of using foreign nominee to manipulate the stock market for the interests of Thai investors who are ultimate beneficiaries.

After taking a lunch break, there was a presentation by a lecturer from the Faculty of Economics, Thammasat University. The presentation was about the economic research assessing the economic impacts of tax evasion caused by the ambiguity of decision rendered by the Department of Excise Tax on the rebuttal case of Shin’s deal – whether or not the shareholders have to pay income tax in the event that they get the stock at the discounted price on hands.

The economic model is mathematically simple, and behavioral explainable in itself. It appears that the more ambiguity the legal text conveys, the more tax evasion by the taxpayers would be. According to the research outcomes, the equivocal legal interpretation would create severe impacts upon tax collection which would in turn resulting in the problem of national budget’s deficiency and economic development in the future.

After presentation, the conference was ended up with a discussion forum led by 4 leading discussants; one from the Kasikorn bank, one from the Faculty of Law of Chulalongkorn University, one from the Faculty of Economics of Thammasat University and the last one from TDRI. They jointly criticised the problem of legal enforcement in Thailand and tried to plot a desirable legal model that suits with the development of Thai society.

In general I was satisfied with the conference. People still stayed with us until the end of conference. In my view, we learned a lot from the conference and hope to see some positive change in our society, which enriched with both economic stability and discerning business ethics.

Political Disorder in Thailand

After a long waiting, I finally get my 3 big parcels having been shipped from the Netherlands since last month. Actually I thought it would take about 10 weeks until its arrival. However, it ultimately takes only 6 weeks which is much faster than I originally expected and so much convenient that I don't have to get them by myself at the post-office. What I have to do is just to wait at my home and sign my name on documents given by a post man. Life is so much easier, and I really happy with that service done by the Post Office. Cheer up and keep improving.

Nothing much about the news other than those regarding the violent confrontation between pro- and anti-Taksin groups as well as the allegation of dereliction of duty against the polices who fail to intervene to halt the violence.

Many financial analysts are wondering whether the situation will be deteriorated, and whether the new election will be postponed. The situation becomes hardly predicted and even turns gloomier. Keep watching.

Tomorrow I will attend a seminar organized by TDRI, a prestigious research institute in Thailand doing a ton of research works on various socio-economic issues, at the Imperial Queen's Park Hotel. This is the first time that TDRI arranges a Mid-Year conference in Bangkok. As far as I know, TDRI has normally arranged the annual conference in Chonburi Province every year. The conference normally takes three days for the whole meeting and many scholars as well as participants from both private and public sector are invited to join the conference and to constructively discuss the issue which is changed every year, but considerably related to the socio-economic situation happening during the time of conference.

For this Mid-year conference, it will take only one whole day. The titled issue is about good corporate governance in private and public sector, focusing on the business deals in some crucial commercial activities; for example land purchasing, equity ownership, which is directed or controlled by Thai nominees being appointed by foreign investors. The conference will be subject to the sales of Shin's stocks.

I think this year's topic is very interesting and extremely useful as it might broaden my understanding about the meaning of "nominee" stipulated by Thai Alien Business Law and to what extent that such practice is allowed under the current Thai legal system. This conference is surely become one of the most highlighted conferences of the year.

After a long waiting, finally I got a reply from the company's senior staff that he acknowledged my email, and already forwarded to the company's HR. I hope sooner or later I will get some news from the company no matter it is good or bad.

During last few days ago, Thai society confronted a new challenge which constituted some bad feelings among Thai people in general and may be considered a starting point of the "social rift" in the near future. The confrontation of two different groups of people, with different attitude over the legitimacy of the Prime Minister to be in the office after the next election in this coming October, has become more intense and brutal. Someone raises concern over this violence as it may develop to the extent that weapons may be used.

Last night I watched a TV program having a representative from both sides; PAD and the Government, to debate the issue that happened during the last three days at the Paragon and Central World Plaza. Although the conversation was running smoothly, both of them discussed the issues on the different political stance and presumption.

For the PAD, a group representative still insisted that although it did not involve with such protestation, people generally have the rights to peacefully express their opinions and political wills by all means. In this regard, the brutal attacks against the protesters were obviously unaccepted, and that caretaker Prime Minister should take responsibility and not be in his premiership he wins the next election. This is the only approach that would help prevent the society from divisiveness and foreseeable political crisis.

However, a representation of the government opined that although the people have a freedom of expression as prescribed by the laws, they also have to follow the rule of law stipulated under the constitution. Social disorder is no good for everyone and would shirk down the economy as a whole. Therefore, under the democratic system, the protestors should accept the government's legitimacy for being in the power and received a majority vote on the last election. He also said that it is more advisable for the protestors to express their political will through a proper voting system which will be held in next two months, and choose whatever choices they want.

I am uncertain what is meaning of Democracy from their views. Equally important, I don't know whether the majority voting that the government won on the last election the Prime Minister always refers to is truly clean or not. But I don't want to see that divisiveness among Thai people happened again in our country, as it was in the past.

Movie Rating Classification

I put up this entry quite late today since I just return back from a meeting party with my senior who has just graduated his PhD in Political Sciences from the University of Hawaii at his new home. His home is located in the Bangkok's vicinity, which took me quite a long time to get there somehow. Although he obtains his degree from a famous university from the oversea country like the US, he still lives in the small house surrounded by trees. I was told that his house is actually the old one brought directly from his hometown in Prea province, a beautiful province in the Northern part of Thailand, and reconstructs it in the traditional style as it was in Prea.

In general, the party was impressive and gave me an opportunity to meet new friends and shared with them some views on many interesting topics; particularly on Thai's Politics, besides the delicious foods I took.

Apart from political issues, I discussed with some of them about the news that I heard this morning about the initiative to reclassify the rating on the Thai movies proposed by the Federation of Thai Firm Industry. This classification is presumed to be one of the most effective tools to inform the audiences upon the movie categories, and to prevent a certain group of audience from watching that movie in the theatre.

Despite of the prospective benefits obtained from this newly proposing rule, the practical outcomes is still questionable and uncertain. I have three main arguments to support my believe;

On the first place, to be able to effectively prevent an audience of certain age group from watching prohibited movies, it is essential that the movie must not be resold across consumers in different age group. This can be economically achieved through a set of different pricing structure among consumers in various age groups. This concept is widely recognized as the theory of price discrimination. In other words, price charged for the qualified elder people should be higher than those unauthorized youngsters. Very personally, merely setting up a rating system without accompanying a proper pricing measure is considered useless, and appeared to be a mere propaganda of the producers to induce the attention of the people in general.

Secondly, although the audiences are successfully prohibited for entering into the theatre, according to the availability of DVD or VCD on every corner, it is uneasy for the government officials or even the producers of movies to prevent those unauthorized audiences from watching the movies outside the cinema. In this regard the restriction is meaningless and unenforceable.

Thirdly, it is utmost important to give a clear meaning and a group classification of the rating that suits with the movie's substance in each category; for instance horror and thriller movie, violent movie or scary movie. However, to give a clear cut within each category might not be so easy and might possibly mark some potential contravesies concerning the comparability between the substance inherent in the domestically produced movies with those imported ones which convey a different cultural attitude in some certain aspects, for example, a sexual relationship among youngsters. In this respect, how to balance the conflicting cultural setting is still suspectible.

It appears that nobody has so far denied or even made a constructive comment in this idea. However, without a careful assessment and apprehensive measures creating real cost burden shouldered by the viewers, a sole rating measure would arguably appear meaningless and could not effectively prevent the youngsters from watching those prohibited movies.

Staying in Bangkok for a While

I have not put any entries since the early of February. Actually the reason was not because I did not have time to do it, but I spent most my time to write my thesis and prepared for my exam. Now everything is done! I finished my LLM study and am looking forwards for another chapter in my life for being a lawyer specialized in the investment law, tax law and antidumping law.

I have been in Bangkok for almost 4 weeks. Nothing was so interesting. So far, apart from working as a subcontractor on a certain project about the international investment law at my previous workplace; TDRI, I also at the same time spend my time searching for a new job at some international law firms located in Bangkok.

I had a good chance to meet and discuss with some law practioner who encouraged me to apply for a job position at his company. Although I showed him my interest in his esteemed law firms and wrote him an email to ask for his kind advise in this matter, I haven't yet received his reply. There is nothing else to do other than to wait, and to reconsider about the job vacancy at some other law firms seriously. Even though I have some working experiences in doing some research about WTO matters, I still have no experience on any legal practices, including taking a bar-exam which I am not so sure whether it is necessary for me and my job as a commercial legal consultant, not as a litigator.

Since my ability to write is still far from perfection, I decided to put up this entry and expect it to be stayed as long as possible. I strongly believe that to be able to use spoken and written English more efficiently and effectively, it is necessary to use it as frequent as possible and learn the mistakes we did. As a result the more mistakes we created, the more we could learn and use them for the better outcomes in the next time.

My short vacation in Thailand

Yesss, I can do it.

Finally, all of my grade exams are reported, and I luckily pass all subjects with an average mark of seven out of ten.

Although the grade I obtained might seem not to be exceptionally outstanding as anyone might expect, I thought that I learned many things from the courses enrolled. Not only was it from the lectures taken within the courses, but also the hard working and perseverance that I ever took throughout the semester make me feel much more confident and learn more how to work hardly and smartly.

According to the lesson I obtained so far, I wish my performance will be considerably improved in the next semester.

What am I looking for to do within next two week prior to the beginning of new semester? Yeap, I plan to spend my one whole week in Thailand with my family and my friends, for the sake of enjoyment and relaxation. And most importantly, I will go back to visit my grand mom. Her health is no good, and she just recently came back from the hospital after her medical check up because of her current physical illness. I prayed for her, and wished I could go through my exam so that I can get back home and see her real soon. Now I can make it.

What am I going to do during my stay in Thailand in a coming week? Umm...

1. My big priority, of course, visit my grand mom
2. Buy handful of English textbooks that going to be used in next semester; may be at Chulalongkorn Bookstore.
3. Continue collecting data and information necessary for working out on my thesis. It would bring me hanging around somewhere at library.
4. Buy some more stationary stuffs.
5. Buy some dvds, movies as well as interesting musics that I missed in the past few months ago. I will bring them back to the Netherlands, and share with my Thai friends such dvds for their own leisure at their place.
6. Buy some more clothes that fit with real cold winter in Europe that will be going to happen in February.
7. Last but not least, enjoy eating as much as I can!!!

I don't know whether I will be able to accomplish all things on time or not, but I wish I could successfully do them all.

การปฏิรูปทางการเมือง : เรื่องของกฎหมาย?

รัฐบาลในยุคปัจจุบันกำลังถูกสั่นคลอนจากข้อครหาในเรื่องการทุจริตคอรัปชั่นในเชิงนโยบายอย่างหนักหน่วง โดยเฉพาะกรณีการขายหุ้นของครอบครัวนายกฯ ที่มีการโยงใยไปถึงเรื่อง conflict of interests ในธุรกิจมือถือและดาวเทียม

แม้รัฐบาลดังกล่าวจะเป็นรัฐบาลเสียงข้างมากสมเจตนารมย์ของรัฐธรรมนูญที่ต้องการให้รัฐบาลมีความเข้มแข็งทางการเมืองเพื่อประโยชน์ในการบริหารราชการแผ่นดิน แต่รัฐบาลชุดเดียวกันนี้กำลังถูกท้าทายจากข้อครหาในการเป็นรัฐบาลที่มีผลประโยชน์ทับซ้อนเป็นอันมาก และมีพฤติกรรมผูกขาด (ไม่ว่าทางการเมือง การตรวจสอบถ่วงดุล หรือทางธุรกิจ)

ดังนั้น ผมจึงได้ยินข่าวคราวเป็นประจำจากเว็บไซต์ว่า มีนักวิชาการกฎหมายส่วนหนึ่งเรียกร้องให้มีการแก้ไขกฎหมายรัฐธรรมนูญ เพื่อนำไปสู่การปฏิรูปทางการเมือง

อย่างไรก็ตาม ผมกลับคิดว่าปัญหาทางการเมืองในปัจจุบันนั้นไม่อาจแก้ไขลำพังเพียงแต่การยกร่างกฎหมายที่กรอบกติกาเท่านั้น

ทำไมผมจึงคิดเช่นนั้น?

ผมมองว่ากระบวนการออกกฎหมาย และใช้กฎหมายในบ้านเราไม่ว่าโดยฝ่ายบริหารหรือนิติบัญญัติเพื่อเอื้อประโยชน์แก่ตนเองและพรรคพวก ล้วนแล้วต้องอาศัยเสียงข้างมากตามวิถึทางของการปกครองตามระบอบประชาธิปไตย และการได้มาซึ่งเสียงข้างมากในสภาเพื่อออกและใช้บังคับกฎหมายนั้นก็ต้องมีจำนวน สส ในสภาที่มากพอที่จะให้รับการรับรองและสนับสนุนร่างกฎหมายนั้นๆ

ดังนั้น การใช้กลยุทธ์ทางการเมืองเพื่อช่วงชิงฐานคะแนนเสียงโดยพรรคการเมืองจึงเป็นสิ่งที่หลีกเลี่ยงไม่ได้ ไม่ว่านโยบายประชานิยม หรือนโยบายอะไรก็ตาม....ดังนั้น ท่านนายกฯ จึงมักเน้นย้ำอยู่เสมอในเรื่องความชอบธรรม และความไว้วางใจที่ได้รับอย่างท้วมถ้นจากประชาชนถึง 19 ล้านเสียงเพื่อเข้ามาบริหารประเทศ

จากข้อสังเกตข้างต้น สิ่งที่ผมคิดว่าเราควรให้ความสนใจมากกว่า ปัญหาในเชิงสถาบันและระบบกฎหมายอย่างที่นักกฎหมายเอ่ยอ้าง ก็คือ 19 ล้านเสียงที่ท่านมักเอ่ยอ้างนั้น มี rationality ในทางความคิดและการตัดสินใจอย่างไร และทำไมถึงตัดสินใจเช่นนี้.....

เพราะหากคนหยิบมือเดียว เลือกพรรคที่ใช้วิธีการหยิบยื่นประโยชน์ หรือซื้อเสียง เราอาจเข้าใจได้ว่าคนกลุ่มนี้เป็นพวกชอบอาศัยผู้อื่น ไม่รู้จักทำมาหากิน.....แต่หากคนกลุ่มๆ เดียวกันนี้มีเป็นจำนวนมาก (แม้จะไม่ถึง 19 ล้านคน แต่ก็คงไม่น้อย) ผมคิดว่า Rationality ของคนกลุ่มนี้น่าสนใจมาก กล่าวคือทำไมคนกลุ่มนี้จึงมีวิธีคิดที่เหมือนกันทั้งตำบล ทั้งจังหวัด หรือทั้งภาค......

ผมคิดว่า คนกลุ่มนี้น่าจะสามารถแบ่งได้เป็นสองกลุ่มย่อย คือ

กลุ่มแรก ได้แก่คนที่อยากเปิดโอกาสให้พรรคที่เรียกตนเองว่า “คิดใหม่-ทำใหม่” ได้มีโอกาสเข้ามาบริหารประเทศ และสอง กลุ่มที่นิยมชื่นชมกับนโยบายในลักษณะประชานิยมที่ตนได้รับประโยชน์จากสิ่งต่างๆ ที่พรรคการเมือง หรือรัฐหยิบยื่นหรือสัญญาว่าจะหยิบยื่นให้

แม้ผมจะไม่สามารถระบุจำนวนได้แน่ชัด แต่ผมว่าคนกลุ่มหลังก็คงมีไม่น้อยแน่ และคงมีมากพอที่จะเป็น Critical mass ที่พรรคสามารถอาศัยเป็นฐานเสียงทางการเมืองได้
Rationality ของคนกลุ่มแรก ผมคิดว่าน่าจะเกิดขึ้นจากความต้องการให้พรรคหน้าใหม่เข้ามาแก้ไข จัดการปัญหาของประเทศที่หมักหมมมานานหลายเรื่องอย่างเด็ดขาด โดยเฉพาะปัญหาวิกฤติเศรษฐกิจ ซึ่งผมคิดว่าเป็น logic ที่เราๆ ท่านๆ สามารถยอมรับได้

ฐานเสียงเช่นนี้ ผมคิดว่าไม่ว่าทั้งคนกรุงหรือต่างจังหวัดล้วนยอมรับได้ทั้งสิ้น และไม่ผิดหากพรรคอื่นๆ จะอาศัยเป็น model ในลักษณะนี้ในการสร้างความนิยม

อย่างไรก็ตาม เมื่อกลับไปมองในกลุ่มที่สอง ผมคิดว่าเราเริ่มประสบปัญหาในการยอมรับ Rationality ที่เกิดจากคนกลุ่มนี้ .....เพราะหากมองจากมาตรฐานของคนในเมือง (ที่ไม่มีปัญหาเรื่องปากท้อง) ผมคิดว่าเกือบร้อยทั้งร้อย มองว่าเป็นเรื่องการซื้อคะแนนที่ยอมรับไม่ได้ บั่นทอนมาตรฐานจริยธรรมทางการเมืองและผิดกฎหมาย

ตรงกันข้าม หากถามชาวบ้าน ชาวบ้านอาจชื่นชอบเพราะเขาได้ประโยชน์ ทรัพย์สินที่ได้รับอย่างชัดเจน ดังนั้นRationality ในเรื่องนี้ก็คือ self-maximization ที่ชาวบ้านได้รับประโยชน์นั่นเอง

ดังนั้นกล่าวถึงที่สุดแล้ว ผมกลับคิดว่าชาวบ้านนั้น Rational มากๆ เพราะเขารู้ว่าตนเองต้องการอะไร และพร้อมจะให้การสนับสนุนคนที่หยิบยื่นประโยชน์ให้แก่เขา หรือชุมชนของเขา ซึ่งต่างกับคนกรุงที่มีความพร้อม ไม่มีปัญหาปากท้อง ไม่ได้ต้องการถนนหนทางเหมือนชาวบ้านในต่างจังหวัด แต่มองปัญหาเรื่องการคอรัปชั่น และประสิทธิภาพในการบริหารจัดการในเชิงมหภาคเป็นเรื่องใหญ่

จากมาตรฐานที่ต่างกันนี้ จึงทำให้ Rationality ของชาวบ้าน (ซึ่งน่าจะเป็นกลุ่มใหญ่ในจำนวน 19 ล้านเสียงที่ว่านั้น) ไม่ได้รับการยอมรับโดยคนกรุง

ดังนั้นผมคิดว่ารากฐานปัญหาการเมืองที่เกิดขึ้นที่สำคัญในปัจจุบัน และอยู่เหนือปัญหาเชิงกฎหมายหรือสถาบันใดๆ ก็คือ "ปัญหาเรื่องปัญหาปากท้อง การศึกษาและทัศนคติในการมองปัญหาที่แตกต่างกันระหว่างคนเมืองกับคนกรุง"

จากข้อสังเกตข้างต้นของผม ผมจึงคิดว่าแม้การประท้วงชุมนุมของคุณสนธิอาจดูสร้างความวุ่นวายในสังคม แต่ในอีกด้านหนึ่ง เราคงพอเข้าใจได้ว่าสิ่งที่คุณสนธิพยายามทำอยู่นั้น ถือเป็นการกระบวนการสร้างความรู้ความเข้าใจทางการเมืองอย่างไม่เป็นทางการแก่ประชาชนโดยทั่วไป โดยเฉพาะ “พ่อแก่แม่แก่” ที่รับฟังทั่วประเทศให้มีความรู้เท่าทัน ถึงผลกระทบที่เกิดขึ้นต่อตนเองและสังคมจากการเลือกนักการเมืองที่ทุจริตคอรัปชั่น และผูกขาด แม้ว่าพวกเขาเหล่านั้นจะได้รับประโยชน์จากนักการเมืองขี้โกงเหล่านั้นเป็นการตอบแทนก็ตาม

ถึงจุดนี้ ผมจึงคิดว่าหากเราไม่สามารถแก้ไขปัญหาปากท้อง การให้การศึกษา แม้เราจะเลือกตั้งอีกกี่ที เราก็จะยังคงได้คนกลุ่มเดีม หน้าเดิมเข้ามาบริหารประเทศ ออกกฎหมายเพื่อผลประโยชน์ตนเองและพวกพ้องเหมือนเดิม และในขณะเดียวกันรัฐบาลที่ตั้งโดยคนต่างจังหวัด ก็จะถูกล้มล้างโดยคนกรุงอยู่ร่ำไป

อย่างไรก็ตาม ประเด็นปัญหาในเรื่องการกำหนดมาตรฐานในเชิงปริมาณ และคุณภาพของการศึกษาในระบบ เพื่อสร้าง “rationality ต้นแบบ” สำหรับเด็กรุ่นหลังในอนาคต ควรเป็นอย่างไรนั้น คงต้องกล่าวกันต่อไปอีกที

Anne Frank House Museum

This is a little flash back story happened during the first week of January this year. I, and my Indonesian friend, Mr. Reza, went together to Amsterdam city with a strong intention to visit "the Anne Frank Museum". We departed from the Rotterdam Central Station around 11.00 am, and it took around one hour for us to get there.

Actually, it was my third time to be there after my first trip took place with my family last year. So I was quite excited to be there to explore Amsterdam by myself again.

I do confess that I did not really know much about the story of Anne Frank before I went there. But after paying 7.5 Euro and spending time looking around, I became impressed with her story and really felt regret with her tragedy that she confronted with in her adolescence.

Who is Anne Frank?

She was one of the Jewish victims during the World War II. Her family moved to the Netherlands to do some warehouse business. During the invasion of German troop, Jews were no longer allowed to own businesses. Therefore, her father, Otto Frank, decided to register his company under the name of his Dutch partners, who played a crucial role in taking care of his business and secretly supplying foodstuffs to the Frank family during their hiding.

In order to survive, Anne and her family decided to hide themselves in the office building of her father and took up residence in this building for two years. However, finally, she, together with her family, was betrayed and arrested by the Nazi soldiers and sent to the Auschwitz extermination camp. Over there, she was died at the age of 15.

Why is the museum so attractive?

This is the real place where the Frank family spent their life hiding from the invading German troop.

The building is roomy and comprised of two sections: the front section of the house using for office management and warehouse, and a back part, the Secret Annex, which is connected by a door concealed by a big wooden movable bookcase.

Behind that thick and heavy bookcase, the audiences are led to many rooms that were originally used by the Frank family during their hiding. Although the annex is comprised of many rooms, the space is quite limited for each of them. It is thus quite interested to learn how they could maintain their normal life in this small place for two years without being discovered or even noticable by the warehousemen working downstairs.

One of the crucial things that kept them safe from being discovered was their silence!!! Anne wrote in her diary that they were prohibited from making noise; no running water, no flushing toilet, or even no walking during the day.

Umm…I enjoyed this trip so much. I think that this might be the best museum that I have ever been in my life. The museum is very attractive, unique, acknowledgeable and not boring. I really enjoyed myself looking around, and as the same time stop thinking something alone and spiritually....

I enjoyed the museum not just because it is a real place having a profound historical background, but also because the place is well organized, highly interactive and well equiped with excellent media displays. I thought.

Although the house has been renovated for public access, making it looked a bit differed from what it used to be, the atmoshere inside is still well preserved and seems to resemable to the original one, so the audiences can easily understand how they maintained their life in this secret place and how they feel during the wartime through Anne’s original written diaries as well as her notebooks.

…..And more importantly, we can understand the impacts of racial discrimination and human rights abuses as well as the severity of war throughout an understanding and a perception of a 12-year-old Anne Frank.

Physicist, Economist, Politician and Lawyer

Have you ever been thinking of the differences among physicist, economist, politician and lawyer?

I accidentally read the column written by Dr. Veerapong Ramangura, the former Finance Minister of Thailand, in the Prachachart Tulakit Newspaper this morning, and he wrote something related to my suspicion. I think his writing is interesting and makes up a good analogy to explain the differences.

He said that physicist is like the one who lives in a bright room. He tries by all means to catch a cat released in that room, and after holding it, he raises and shows it around to other people, confirming that what appears in his hands is a cat.

Unlike economist, he seems to be a blind person working out in a dark room. He tries to catch a cat, but he never makes it no matter how hard he tries. Althought he never suceeds his duty, he never and ever deceives other people that he can make it.

However, Politician, in the contrary, always claims that he can catch one, although he really found nothing. Ironically he never shows up what he really found, but always makes other people believe he does make it.

Lawyer is smarter than any others. He catches nothing, and never deceives other people or even lies them that he can make it. He has no ideas, but tries to find out how to work out smoothly and smartly.

In doing so he starts thinking of enacting the laws expecting that a cat would avail itself, and run to him because of fear!!!

เสียงพลุดังกึกก้องเมืองรอตเตอร์ดัม

เสียงคนโหวกเหวกออกมาเต็มถนนหน้าบ้าน ทั้งๆที่ก่อนหน้านี้มันเงียบไปทุกหนทุกแห่ง

เสียงรถยนต์ต่างวิ่งออกมาประชันเสียงแตรกันทั่วเมือง พร้อมๆ กับเสียงรถพยาบาลที่ส่งเสียงไซเลนดังเป็นระยะ เพื่อนำพาคนป่วยไปยังโรงพยาบาลที่อยู่ใกล้

ถ้าเป็นค่ำคืนอื่นๆ เวลานี้ ผมคงนอนหลับฝันดีไปเรียบร้อยแล้ว และคงปล่อยให้เวลาเดินทางเข้าสู่รุ่งอรุณวันใหม่ อย่างที่มันเป็น

แต่วันนี้ ผมนั่งเฝ้า คอยดูเวลาที่กำลังผ่านพ้นไป พร้อมกับความตื่นเต้นของการมาเยือนแห่งรุ่งอรุณแห่งวันใหม่....โดยใจจดจ่อ

พร้อมกับนั่งบันทึก ความทรงจำของปีที่ผ่านมา และวางแผนชีวิตที่จะต้องดำเนินในปีถัดไป

จะว่าไป ชีวิตมันก็เหมือนความฝัน

ผมลองมานั่งนึกดู ปีที่ผ่านมาอาจเรียกได้ว่าเป็นปีทองของผมก็ว่าได้

ไม่ใช่ว่าถูกหวยถูกล็อตเตอร์ลี่อะไร แต่เพราะเป็นปีที่มีสิ่งต่างๆ เกิดขึ้นกับตัวผมมากมาย จนอาจเรียกได้ว่าเป็นปีที่สร้างจุดเปลี่ยนในชีวิตของผมก็ว่าได้

นับแต่ราวเดือนมกราคมของปีที่ผ่านมา ผมเรียนจบนิติศาสตร์ ที่รามคำแหง

ก่อนจบ ผมมีความใฝ่ฝันที่อยากจะเรียนต่อมากกว่าการสอบเนฯ หรือสอบเป็นผู้พิพากษาอัยการ ดังนั้นวิชาที่ผมเลือกเรียนจึงเป็นวิชาที่ผมไม่สนใจความยากลำบากในการทำเกรด (ทั้งๆ ที่ต้องทำเกรดด้วย)แต่ให้ความสำคัญกับประโยชน์ที่จะได้รับจากการเรียนมากกว่าเรื่องอื่นๆ

ผมจบด้วยเกรดเทอมสุดท้ายสี่จุดศูนย์ศูนย์ ไม่ใช่เก่งกาจอะไร แต่เป็นเพราะการวางแผนที่ดี ความมุ่งมั่น และการหว่านล้อมแกมขู่บังคับของสาวใกล้ตัว ทำให้ความมุ่งมั่นในการเรียนต่อไม่เคยแปรเปลี่ยน

พอเรียนจบ ผมลังเลว่าจะเอายังไงกับชีวิตต่อไปดี เพราะถ้าเรียนต่ออเมริกาก็คงไม่ทัน เพราะผมเพิ่งจบ ถ้าจะสมัครก็คงต้องรอปีถัดไป ซึ่งผมคงต้องเสียเวลาเพิ่มอย่างไม่จำเป็น ผมเลยตัดสินใจเรียนต่อทางยุโรป เพราะมหาวิทยาลัยส่วนมากกำหนดเส้นตายในการยื่นใบสมัครภายในกลางปี และเปิดเทอมในช่วงปลายปี ซึ่งคิดได้อย่างนั้น ผมจึงตัดสินใจกลับมาทำงานที่ TDRI ที่ทำงานเก่าก่อนที่ผมจะลามาเรียนกฎหมายตามที่ใจเรียกร้อง

เหตุผลสำคัญที่ผมกลับมาทำงานก็คือ หนึ่งผมต้องการฝึกฝนทักษะบางอย่างที่ผมขาดและคิดว่าจำเป็นต่อการเรียนต่อระดับสูง ผมต้องการสร้างความพร้อมทั้งร่างกายและจิตใจ เพื่อไม่ให้ปอดแหก ถ้าได้มาเรียนต่อจริงๆ

สองผมต้องการเก็บทุนรอนเพื่อเรียนต่อ ผมไม่ต้องการขอทุนจากใคร ไม่อยากผูกพันกับหน่วยงานใด ผมอยากมีอิสระในการใช้ชีวิตและการทำงานให้มากที่สุด ดังนั้นถ้าไม่ขอพ่อแม่ ก็คงต้องเก็บตังค์เอาเอง แต่โชคดีที่ผมมีเงินเก็บพอควรจากการเก็บหอมรอมริบหลายปี ดังนั้นผมคิดว่าระยะเวลาครึ่งปีผมคงหาส่วนที่เหลือได้ไม่ยาก

ผมกลับมาทำงานที่ TRDI ประมาณปลายเดือนมกราคม 2548 โดยได้รับการบรรจุเป็นนักวิจัยของสถาบันฯ และได้ทำงานวิจัยในเรื่องที่ผมสนใจ โดยเฉพาะ Economic Regulations ที่เกี่ยวข้องกับประเด็นกฎหมายด้านการค้าและการลงทุนระหว่างประเทศ

ไม่รู้จะนับว่าเป็นโชคชะตา หรืออะไรก็แล้วแต่ ปรากฎว่าในปีที่ผ่านมารัฐบาลไทยให้ความสนใจกับการจัดทำข้อตกลง FTA กับหลายประเทศ โดยเฉพาะอย่างยิ่งญี่ปุ่นและสหรัฐอเมริกา หน่วยงานที่ผมสังกัดอยู่จึงได้รับมอบหมายให้ทำการศึกษาวิจัยในเรื่องสำคัญหลายๆเรื่อง ผมจึงได้รับโอกาสที่ดีในการเป็นคณะผู้วิจัยในหลายโครงการซึ่งได้รับมอบหมายทั้งจากรัฐบาลและภาคเอกชน

การทำงานของผมในช่วงครึ่งปีนี้ ผมได้รับมอบหมายให้ทำงานใหญ่หลายชิ้น และได้เรียนรู้การทำงานวิจัยที่เรียกได้ว่าเกือบครบทั้งกระบวนการด้วยตนเอง นับตั้งแต่การเขียนข้อเสนอวิจัย (proposal) การรวบรวมข้อมูลทั้งจากการสัมภาษณ์และเก็บข้อมูลจากเอกสาร การเขียนงานวิจัยในเรื่องใหม่ๆ การติดต่อประสานงาน การนำเสนอผลงานในวงแคบเฉพาะผู้เกี่ยวข้องจนถึงขึ้นเวทีในโรงแรมต่อหน้าคนจำนวนมาก รวมทั้งการจัดทำรูปเล่มส่งโรงพิมพ์

นอกจากนี้ด้วยภาระหน้าที่ ผมจึงได้มีโอกาสพบปะผู้คนมากมายในหลายวงการ ทั้งพ่อค้า นักธุรกิจ ข้าราชการ รวมทั้งนักกฎหมายที่มีส่วนเกี่ยวข้องทั้งที่อยู่ในภาครัฐและเอกชน

การได้พบปะกับผู้คนหลากหลาย ทำให้ผมพบว่ายังมีนักกฎหมายอีกกลุ่มนอกเหนือจากผู้พิพากษาและอัยการที่สามารถทำประโยชน์แก่สังคมได้ไม่แพ้กัน และยังเป็นที่ต้องการของสังคมอย่างมากเช่นกัน

การค้นพบข้อเท็จจริงดังกล่าว ทำให้ผมเริ่มมีความมั่นใจ และมีความมุ่งมั่นที่จะเป็นนักกฎหมายในแบบที่ผมที่ใฝ่ฝัน ไม่ใช่ต่อสู้คดีเพื่อเอารัดเอาเปรียบใครคนใดคนหนึ่ง แต่เพื่อประโยชน์ในทางเศรษฐกิจของประเทศโดยรวม

อย่างไรก็ตาม....พื้นฐานความรู้ที่มั่นคง แข็งแรงกว่านี้เป็นสิ่งจำเป็นสำหรับผม ดังนั้นเป้าหมายในการเรียนต่อต่างประเทศในมหาวิทยาลัยที่ดีจึงมีความสำคัญไม่ยิ่งหย่อนไปกว่าประสบการณ์ทำงาน แต่จะทำได้อย่างไรถ้ายังไม่ได้สอบ TOEFL หรือ IELTS

ผมเตรียมตัวสอบภาษาอังกฤษด้วยตัวเองโดยไม่ได้ไปพึ่งพาสถาบันกวดวิชาที่ไหนๆ (ยกเว้นให้พี่ที่รู้จัก ช่วยแนะนำเรื่องการเขียนภาษาอังกฤษ) และสอบผ่านเกณฑ์ที่ทางมหาวิทยาลัยในยุโรปกำหนด

ประมาณเดือนพฤษภาคม ผมตัดสินใจยื่นใบสมัครตามมหาวิทยาลัยต่างๆ ในยุโรป แต่ผมก็ยังมีความลังเลในเรื่องโปรแกรมที่จะเรียนต่อว่าผมควรเลือกเรียนสายกฎหมาย WTO อย่างที่ผมตั้งใจแต่แรก หรือควรเลือกโปรแกรมกฎหมายที่เน้นความรู้ความเข้าใจในกฎหมายพื้นฐานที่เกี่ยวข้องกับทางด้านธุรกิจให้ดีเสียก่อน แล้วค่อยต่อยอดภายหลัง

เผอิญผมในช่วงก่อนหน้านั้นไม่นาน ผมได้เจอกับรุ่นน้องที่ธรรมศาสตร์คนหนึ่ง ปัจจุบันทำงานที่สภาอุตสาหกรรมฯ เราพูดคุยกันเรื่องการทำงาน พอน้องเขาทราบเข้าก็ได้แนะนำให้ผมลองคุยกับนักกฎหมายท่านหนึ่งซึ่งเป็นที่ปรึกษากฎหมายให้กับสภาอุตสาหกรรมฯ น้องคนนั้นให้ชื่อและเบอร์ติดต่อของนักกฎหมายรุ่นใหญ่คนนั้นมาให้ผม

ผมตัดสินใจเขียนอีเมล์ไปยังที่อยู่ที่ปรากฏในนามบัตรนั้น และถามคำถามที่ยังค้างคาใจสองสามประเด็น ผมแทบไม่ได้คาดหวังเลยว่าผมจะได้รับคำตอบใดๆ กลับมา

2-3 วันให้หลัง ผมได้รับอีเมล์ตอบกลับมา นักกฎหมายท่านนั้นไม่เพียงแต่ตอบคำถามผม แต่ยังเสนอให้ผมเข้าไปพบโดยตรงที่สำนักงานของท่าน

ผมจำได้ว่าผมดีใจมาก ผมเลยรีบโทรศัพท์ติดต่อเลขาฯของนักกฎหมายผู้นั้นเพื่อนัดหมายวันเวลาเข้าพบ

ผมยังจำวันนั้นได้ดีเสมอ ผมไปพบท่านตามเวลาในห้องประชุมที่สวยงามโอ่โถง ท่านมาตามเวลาที่นัดเป๊ะ no more no less เราเริ่มพูดคุยกัน และผมก็จู่โจมด้วยชุดคำถาม บรรยากาศการพูดคุยเป็นไปอย่างราบรื่น นักกฎหมายท่านนั้น ไม่เพียงแต่รู้เรื่องกฎหมายดี แต่ยังสนใจที่จะถ่ายทอดความรู้แก่นักศึกษากฎหมายที่สนใจอีกด้วย

ผมปิดท้ายด้วยการขอคำชี้แนะจากท่านในการเรียนต่อ

ไม่รู้จะเป็นด้วยโชคชะตาหรืออะไรมาดลใจ ท่านได้เอ่ยชวนผมมาร่วมงานที่สำนักงานท่านในตำแหน่งที่ปรึกษากฎหมาย แม้จะสะกดความดีใจไว้ แต่ผมคิดว่าผมคงเก็บอาการไว้ไม่อยู่ทั้งหมด ผมบอกท่านว่าขอกลับไปคิดดูก่อน

แม้ว่าจะเป็นโอกาสที่ดีในชีวิต แต่ผมคิดว่าผมเองยังด้อยประสบการณ์ และยังต้องหาความรู้เพิ่มเติมอีกมาก สองวันหลังจากนั้น ผมตัดสินใจเลือกที่จะเรียนต่อมากกว่าทำงานในเวลานี้ ผมตอบท่านไปและขอบคุณในความหวังดีของท่าน ท่านก็อวยพรให้ประสบผลสำเร็จในการเรียน พร้อมกับขอ resume ของผมไว้ เผื่อผมสนใจอยากจะทำงานกับท่าน

หลังจากนั้นประมาณเดือนมิถุนายน ผมก็ส่งใบสมัครมายังมหาวิทยาลัยอีรัสมุสแห่งเมืองรอตเตอร์ดัม และได้รับการตอบรับราวปลายเดือนกรกฎาคม

ผมออกเดินทางจากดอนเมืองปลายสิงหาค,และมาถึงเมืองรอตเตอร์ดัม ประเทศเนเธอร์แลนเมื่อวันที่ 30 สิงหาคม 2548 และอาศัยอยู่ที่นี่จนถึงเวลานี้ก็ 4 เดือนแล้ว

สิ่งที่ผมได้ประสบในช่วงปีที่ผ่านมาไม่ว่าสุขหรือทุกข์ ล้วนแล้วแต่เป็นประสบการณ์ที่ดี ที่หล่อหลอมให้ผมแข็งแกร่งและฉลาดในการใช้ชีวิตมากขึ้น

บางทีความสำเร็จที่มาจากความมุมานะก็มาพร้อมๆ กับสายลมแห่งโชคชะตา จนบางครั้งก็แยกออกจากกันได้ลำบาก

แต่สิ่งที่ผมเรียนรู้อย่างหนึ่งในช่วงปีที่ผ่านมาก็คือ การทำงานหนัก จริงจัง และอย่างเป็นระบบ จะให้ผลดีในระยะยาว

ในปีใหม่นี้ ผมไม่รู้ว่าจะมีอะไรเกิดขึ้นกับผมบ้าง แต่ประสบการณ์ที่ผ่านมาก็สอนให้ผมรู้อีกเช่นกันว่า คนเราแพ้แล้วอย่าแพ้เลย ถ้าโง่แล้วก็อย่าโง่นาน และหากล้มแล้วก็ต้องรีบลุกเพื่อรอรับสิ่งใหม่ที่กำลังเกิดขึ้น

ผมหวังว่าปีใหม่นี้ ผมจะเรียนจบโดยเร็ว และมีอุปสรรคปัญหาน้อยที่สุด

งานแต่งงาน

อาทิตย์ก่อน (23 ธันวาคม 2548) ผมได้มีโอกาสไปร่วมงานแต่งงานของรุ่นพี่ท่านหนึ่ง ซึ่งกลายเป็น "ดร." หมาดๆ ก่อนหน้าวันแต่งงานเพียงหนึ่งวัน

คู่สมรสเป็นคนต่างชาติต่างภาษากัน ฝ่ายเจ้าบ่าวเป็นหนุ่มนักวิชาการไทยอนาคตไกลที่มาเรียนเศรษฐศาสตร์ที่มหาวิทยาลัยอีรัสมุสนับได้เป็นเวลา 6 ปีพอดี ส่วนเจ้าสาวเป็นสาวไต้หวันที่บินข้ามน้ำข้ามทะเลมาเรียนทางด้าน MBA

เท่าที่ได้ทราบ ทั้งคู่รู้จักกันเนื่องจากทั้งคู่อยู่หอพักนักศึกษาเดียวกัน และห้องติดกัน ความรู้จักคุ้นเคย พัฒนาความสัมพันธ์ จนกลายเป็นคู่รัก และแม้ฝ่ายหญิงจะเรียนจบกลับไปก็ไป แต่ทั้งคู่ก็ยังคงติดต่อกัน จนทั้งคู่ตัดสินใจแต่งงานกัน

งานแต่งงาน จัดอย่างเรียบง่ายที่ town hall ของเมืองรอตเตอร์ดัม

ผู้มาร่วมงาน ก็ไม่ใช่ใครอื่นไกล ก็พี่ๆน้องๆ นักเรียนไทยในเมืองที่ไปมาหาสู่กันนั่นเอง รวมทั้งเพื่อนของเจ้าบ่าวมาร่วมงานด้วย

เวลานัดเจอประมาณ 11.45 น. วันนั้นเจ้าบ่าวและเจ้าสาวแต่งกายสวยสดงดงามมาก มีเพียงเพื่อนพี่น้องที่สนิทที่มาร่วมงาน แม้จะมีจำนวนไม่มาก แต่ทุกคนมีสีหน้าที่บ่งบอกถึงความสุข และยินดีกับพี่ชายคนนี้

หลังจากถ่ายรูปที่ห้องโถงด้านล่างพอเป็นการอุ่นเครื่องด้านล่างแล้ว พวกเราก็เคลื่อนขบวนขึ้นไปยังชั้นสองของที่ทำการตึก town hall งานนี้ ไม่มีการกั้นประตูเงินประตูทองนะครับ เพราะฉะนั้นเจ้าบ่าวจึงไม่กระเป๋าฉีกงานนี้

ที่ห้องโถงดังกล่าว สิ่งที่สะดุดตาผมก็คือ รูปปั้นครึ่งท่อนของนายพลวินสตั้น เชอร์ชิล นายพลคนดังแห่งอังกฤษที่สภาเมืองรอตเตอร์ดัมจัดสร้างไว้ เพื่อเป็นอนุสรณ์และเป็นเกียรติแก่นายพลท่านนี้ที่ช่วยเหลือเมืองรอตเตอร์ดัมจากการคุกคามของกองทัพเยอรมันในสงครามโลกครั้งที่สอง

เมื่อขึ้นมาถึงชั้นสองแล้ว ผู้มาร่วมงานก็เดินเข้าสู่ห้องพิธี ซึ่งผมเข้าใจว่าทาง town hall เขาจัดสร้างเพื่อเป็นสถานที่ทำพิธีจดทะเบียนโดยเฉพาะ ซึ่งสวยงามและดูอลังการมาก

ในห้องดังกล่าว มีแถวม้านั่งเหมือนในโบสถ์ให้ผู้ร่วมงานเข้ามานั่งเป็นสักขีพยาน ส่วนด้านหน้าก็เป็นโพเดียมของประธานซึ่งเป็นเจ้าหน้าที่จากเมือง และผู้ช่วยอีกหนึ่งคน

ผู้ร่วมงานจะต้องเข้ามานั่งในห้องก่อน เพื่อซักซ้อมความเข้าใจกับประธานในพิธี และเพื่อรอต้อนรับคู่บ่าวสาวที่จะเดินเข้ามาทีหลัง โดยมีเสียงเพลงออแกนส์เคล้าคลอประกอบระหว่างพิธี ไพเราะจริงๆ ครับท่าน ไม่ใช่เปิดเทป แต่มีคนมาเล่นจริงๆ

เมื่อคู่บ่าวสาวเข้ามาในบริเวณพิธีแล้ว ก็จะไปนั่งยังที่นั่งที่จัดไว้ด้านหน้าโพเดียมประธาน

จากนั้นประธานในพิธี ก็จะกล่าวแนะนำคู่บ่าวสาวให้คนที่มาร่วมพิธีได้รู้จักพอหอมปากหอมคอ ว่ามีชื่อเสียงเรียงนามอะไร มาจากไหน เป็นลูกเต้าเหล่าใคร ทำไมถึงมาเจอกันได้ และตัดสินใจแต่งงาน ณ ที่แห่งนี้

ต่อจากนั้นประธานในพิธีก็กล่าวแนะนำประวัติความเป็นมาของสถานที่ประกอบพิธี ซึ่งเท่าที่ผมเห็น ส่วนใหญ่ก็เป็นเรื่องคติความเชื่อในเรื่องความรักตามแนวคิดของฝรั่งซึ่งผมเองก็เข้าใจบ้างไม่เข้าใจบ้าง แต่ก็ยอมรับว่าที่แห่งนี้มันมีมนต์เสน่ห์และความงดงามที่ใครได้มาประกอบพิธีก็คงได้รับความประทับใจกลีบไปไม่มากก็น้อยอย่างแน่แท้

หลังจากกล่าวอะไรต่อมิอะไรเสร็จ ก็เข้าสู่ช่วงไคล์แมกซ์ ประธานในพิธีกล่าวถึงความสำคัญของการสมรสและสถาบันครอบครัว เมื่อกล่าวเสร็จก็ให้ทั้งคู่ยืนขึ้นและกล่าวยืนยันในการเป็นคู่สมรสตามกฎหมาย โดยที่แต่ละฝ่ายกล่าวสั้นๆ เพียงว่า Yes, I do

เนื้อหาสาระหลักๆ ก็คือเจ้าบ่าวเจ้าสาวต้องดูแลซึ่งกันและกัน มีความจงรักภักดีต่อกันตลอดไป จากนั้นก็แลกแหวนแต่งงานกัน (โดยมีประธานคอยบอกบท) และจดทะเบียนสมรสโดยมีสักขีพยานลงนามรับรองจำนวนสี่คน ซึ่งก็ไม่ใช่ใครที่ไหนแต่เป็นเพื่อนของเจ้าบ่าวที่อุตส่าห์บินข้ามน้ำข้ามทะเลเพื่อมาร่วมในวันสำคัญนี้

ในท้ายสุดหลังจากจดทะเบียนแล้ว ประธานก็กล่าวยินดี และประกาศให้คู่บ่าวสาวทั้งสองเป็นสามีภรรยาตามกฎหมาย เป็นอันจบพิธี

ที่เล่ามาทั้งหมดนี้ใช้เวลาเบ็ดเสร็จประมาณ 45 นาทีครับ

เป็นงานแต่งงานงานแรกในชีวิตที่ผมได้มาสัมผัสในเมือง (บ้าน)นอก

แม้จะใช้เวลาไม่นาน แต่ผมรู้สึกว่าอิ่มเอิบ และมีความสุขมากกว่างานไหนที่ผมเคยไปมา.....ทั้งหมด

เพราะที่ผ่านมา ผมรู้สึกว่างานแต่งงานที่ผมเคยไปมาในประเทศไทยไม่ว่าในกรุงเทพฯ หรือต่างจังหวัด ไม่ว่าของเพื่อนหรือญาติพี่น้อง มักเป็นเรื่องของ "ครอบครัว" มากกว่าเรื่องของ "คู่บ่าวสาว"

พ่อแม่แต่ละฝ่ายจะมีส่วนเกี่ยวข้องอย่างมากในการตระเตรียมการ น้อยรายมากที่ดำเนินการโดยคู่บ่าวสาวโดยลำพัง ยังไม่นับรวมถึงการช่วยเหลือทางด้านการเงินจากพ่อแม่ ซึ่งไม่ใช่จำนวนที่น้อยเลย

บางงานยิ่งหนักเข้าไปใหญ่ กลายเป็นงานที่ต้องแบกหน้าตาของพ่อแม่เข้าไปด้วย....บางทีคู่บ่าวสาว แทบไม่เคยรู้จักเลยว่าใครมางานเขาบ้าง นอกจากว่าเขาเหล่านั้นเป็นเพื่อนพ่อแม่พี่ป้าน้าอา ...โดนจับไปถ่ายรูป เหมือนละครสัตว์

บางงานยิ่งแย่ คู่บ่าวสาวที่กำลังจะเริ่มชีวิตใหม่ ย่างก้าวไปในอนาคต กลับต้องแบกรับภาระเป็นหนี้เป็นสินเป็นจำนวนมากจากการจัดงานแต่งงานในสถานที่หรูหรา เชิญคนจำนวนมาก...โดยไม่จำเป็น

แม้จะมีหลายคนบอกว่า...พิธีกรรมดังกล่าวเป็นสิ่งจำเป็นสำหรับสังคมไทย และคงอยู่คู่วัฒนธรรมไทยอีกนาน

แต่ถ้าเรามามองในสารัตถะของมัน ผมพบว่ามันก็ไม่ได้แตกต่างจากงานแต่งงานที่ผมได้ไปมาเมื่อสัปดาห์ก่อน ที่ริเริ่มดำเนินการโดยคน "ตัวเล็กๆ" สองคนโดยลำพัง และใช้อีเมล์ในการนัดหมายคนที่รู้จักแทนการออกการ์ดเชิญราคาแพงๆ รวมทั้งกินข้าวเย็นร่วมกันโดยมีเพื่อนๆ พี่ๆ น้องๆ ช่วยกันทำอาหารติดไม้ติดมือมาร่วมงานอย่างละนิดอย่างละหน่อย

ผมว่านะ เท่านี่มันก็มีความสุขแล้ว แบบพอเพียง และมีสติ

และที่สำคัญ มันเป็นวิธีแสดงออกอย่างง่ายๆ ว่าเขาและเธอมีความพร้อมที่ก้าวย่างไปในอนาคตมากน้อยเพียงไร มีความรับผิดชอบต่อครอบครัวเล็กๆ ของตนโดยที่ไม่ต้องสร้างภาระให้คนรอบข้างได้อย่างไร

มหาวิทยาลัยของฉัน

วันนี้ผมอยากเล่าสู่กันฟังเรื่องมหาวิทยาลัยที่ผมกำลังศึกษาในประเทศกังหันสีส้ม

มหาวิทยาลัยที่ผมเล่าเรียนอยู่นี้มีชื่อเป็นทางการว่า "Erasmus University Rotterdam" (EUR)

EUR ถือเป็นมหาวิทยาลัยสำคัญแห่งหนึ่งในประเทศเนเธอร์แลนด์จากจำนวนทั้งสิ้น 13 แห่ง ในจำนวนดังกล่าว 9 แห่งเปิดสอนสาขาวิชาการทั่วไป ส่วนอีก 4 แห่งเปิดสอนเฉพาะทาง โดย 3 แห่งเปิดสอนทางด้านวิศวกรรม และอีก 1 แห่งเปิดสอนทางด้านเกษตรกรรม

มหาวิทยาลัยในประเทศเนเธอร์แลนด์ล้วนแล้วแต่เป็นมหาวิทยาลัยของรัฐ (State University) ซึ่งได้รับการอุดหนุนงบการศึกษาจากรัฐบาลและอยู่ภายใต้การควบคุมด้านมาตรฐานการศึกษาโดยรัฐบาล ดังนั้นจึงไม่แปลกใจว่าทำไมมหาวิทยาลัยที่นี่จึงไม่มีการจัดอันดับ (Ranking) เหมือนกับทางสหรัฐอเมริกา

อย่างไรก็ตาม จากการจัดอันดับมหาวิทยาลัยสำหรับปีล่าสุด (2005)โดยนิตยสารไทม์สำหรับด้านสังคมศาสตร์ (Social Sciences)ปรากฎว่าในปีนี้ EUR ได้เลื่อนขึ้นชั้นมาจากอันดับที่ 60 เมื่อปี 2004 มาเป็นอันดับที่ 20 ในปี 2005 และยังเป็นมหาวิทยาลัยดัชต์แห่งเดียวในเนเธอร์แลนด์ที่ติดอันดับ 1 ใน 50 ของโลกด้วย

ผลการจัดอันดับดังกล่าวจึงทำให้คนที่นี่ภูมิใจนักภูมิใจหนาว่าข้าก็ดีไม่แพ้ใครในยุโรป จะรองก็แค่มหาวิทยาลัยเก่าแก่ในอังกฤษ อันได้แก่เคมบริดส์ ออกซ์ฟอร์ด และลอนดอนเท่านั้น

แม้จะมีข้อโต้แย้งในเรื่องความน่าเชื่อของการจัดอันดับ แต่สิ่งที่ผมคิดว่าน่าสนใจมากกว่าสำหรับมหาวิทยาลัยแห่งนี้ก็คือ มหาวิทยาลัยแห่งนี้ได้มีการวางเป้าหมายที่ชัดเจนในการเป็นศูนย์กลางทางการศึกษาทางด้านวิชาการเชิงพาณิชยศาสตร์มาตั้งแต่เริ่มก่อตั้ง

ย้อนไปเมื่อประมาณ 90 ปีที่แล้ว มหาวิทยาลัยแห่งนี้ได้ถูกจัดตั้งโดยความร่วมมือของกลุ่มสมาคมพ่อค้าในเมืองร็อตเตอร์ดัมที่เล็งเห็นความสำคัญของการเป็นเมืองท่าสำคัญในยุโรป และต้องการสนับสนุนให้มีการจัดตั้งสถาบันการศึกษาเฉพาะทางสำหรับด้านการพาณิชย์เพื่อรองรับการขยายตัวทางการค้าสำหรับเมืองท่าแห่งนี้

แรกเริ่มเดิมทีนั้น มหาวิทยาลัยแห่งนี้ไม่ได้ชื่อ อิรัสมุสอย่างทุกวันนี้ มีเพียงแต่ The Netherlands School of Commerce ซึ่งเริ่มก่อตั้งในปี 1913 และขยายขอบเขตการศึกษาครอบคลุมไปยังด้านเศรษฐศาสตร์ด้วย และในปี 1939 ก็ได้เปลี่ยนชื่อใหม่ภายหลังเป็น The Netherlands School of Economics

ต่อมายุคทศวรรษที่ 60 คณะต่างๆ จึงได้ทยอยถือกำเนิดขึ้นมาตามลำดับ อันประกอบด้วย คณะนิติศาสตร์ ปรัชญา ประวัติศาสตร์ และศิลปะ

ในราวปี 1966 ได้มีการจัดตั้งสถาบันทางการแพทยศาสตร์ขึ้นเป็นครั้งแรกในเมืองร็อตเตอร์ดัม มีชื่อว่า Medical Faculty Rotterdam สถาบันแพทยศาสตร์ดังกล่าวในภายหลังได้ผนวกรวมกับ Sophia's Children Hospital และ Daniel den Hoed Clinic และจัดตั้งขึ้นเป็นวิทยาลัยแพทยศาสตร์ University Hospital Rotterdam ซึ่งได้เปลี่ยนชื่อในภายหลังว่า Erasmus MC และใช้เรียกขานอย่างเป็นทางการมาจนถึงทุกวันนี้

ในปี 1973 University Hospital Rotterdam และ The Netherlands School of Economics ได้ผนวกรวมกันและร่วมกันจัดตั้งเป็นมหาวิทยาลัยขึ้นและได้นำชื่อของนักปราชญ์ชาวดัชต์คนสำคัญ Desiderius Erasmus(1466-1536)มาตั้งชื่อมหาวิทยาลัย ภายใต้ชื่อ Erasmus University Rotterdam เพื่อเป็นการยกย่องนักปราชญ์ดัชต์คนสำคัญที่มีอิทธิพลทางความคิดด้านศาสนาและมนุษยวิทยาในยุโรปในยุคนั้น

ในปัจจุบัน มหาวิทยาลัยอิรัสมูสแห่งเมืองร็อตเตอร์ดัม มีคณะดังขึ้นชื่อและติดทำเนียบท๊อประดับโลก 2 คณะ คือคณะบริหารธุรกิจ (MBA) และคณะเศรษฐศาสตร์ ซึ่งมีการผลิตผลงานวิชาการมากมายและเป็นที่ยอมรับในระดับสากล

และเมื่อกล่าวถึงวิชาการด้านเศรษฐศาสตร์ หลายคนที่เรียนเศรษฐศาสตร์คงไม่ทราบว่าวิชาเศรษฐมิติ (Econometric) ที่นักศึกษาอีคอนต่างปวดเศียรเวียนเกล้าไปตามๆกันนั้น ถือกำเนิดโดย Dr. Jan Tinbergen อดีตนักศึกษาด้านฟิสิกส์ที่หันมาเอาดีด้านเศรษฐศาสตร์ และได้กลายมาเป็นอาจารย์ทางด้านเศรษฐศาสตร์ที่มหาวิทยาลัยแห่งนี้

เท่าที่ผมเคยทราบ Jan Tinbergen ผู้นี้รู้จักมักคุ้นกับ อาจารย์ ป๋วย อึ้งภากรณ์ และในสมัยที่อาจารย์ ป๋วย ดำรงตำแหน่งผู้ว่าการธนาคารแห่งประเทศไทย Jan Tinbergen ก็เคยทาบทามให้ท่านส่งนักเรียนไทยไปเรียนทางด้านเศรษฐศาสตร์ที่เนเธอร์แลนด์ แทนที่จะส่งไปเรียนแต่ที่สหรัฐอเมริกาและอังกฤษเท่านั้น นักเรียนไทยที่ได้รับคัดเลือกไปศึกษาในครั้งนั้นก็ไม่ใช่ใครที่ไหนอื่นไกล แต่เป็น ดร.ศุภชัย พาณิชภักดิ์ หรือ ดร.ซุป ที่เรารู้จักนั่นเอง

Jan Tinbergen เป็นผู้นำวิชาเศรษฐมิติที่ว่านี้มาใช้อธิบายปรากฎการณ์ทางเศรษฐกิจที่เกิดขึ้นในสหรัฐอเมริกา และด้วยผลงานของท่านนี่เอง ก็ทำให้ท่านสามารถคว้ารางวัลโนเบลทางด้านเศรษฐศาสตร์มาครองได้เป็นผลสำเร็จในปี 1969 ซึ่งเป็นปีแรกที่มีการมอบรางวัลสำหรับสาขาเศรษฐศาสตร์นับแต่ได้มีการมอบรางวัลโนเบลตั้งแต่ปี 1901

ผลงานของท่านจึงเป็นการเปิดพรมแดนความรู้ทางด้านเศรษฐศาสตร์ที่หลากหลายและได้สร้างคุณูปการแก่นักเศรษฐศาสตร์รุ่นหลังจนถึงทุกวันนี้

Jan Tinbergen เสียชีวิตเมื่อปี 1994 ปัจจุบันมหาวิทยาลัยได้มีการจัดตั้งสถาบันวิจัยทางด้านเศรษฐศาสตร์ และได้นำชื่อท่านเป็นชื่อสถาบัน ซึ่งมีชื่อว่า "Tinbergen Institute" ซึ่งอยู่ภายในตึก H Building ซึ่งตั้งตระหง่านกลางมหาวิทยาลัยดังที่เห็นในรูปข้างบน นอกจากนี้ยังได้มีการจัดสร้างลานนั่งเล่นชื่อว่าสวน Tinbergen เพื่อเป็นอนุสรณ์รำลึกถึงท่านซึ่งปัจจุบันลานดังกล่าวตั้งอยู่หลังตึกคณะนิติศาสตร์ของผม และผมก็มักจะใช้เวลาหลังเลิกเรียนไปนั่งเล่นนั่งคุยกับเพื่อนเป็นประจำ

เปิดเรียน

ผมเปิดเรียนภาคการศึกษาแรกมาได้หนึ่งสัปดาห์แล้ว หลักสูตรที่ผมเข้าเรียนนี้เรียกว่า LLM (Business and Trade Law) มีระยะเวลาเรียนประมาณหนึ่งปี (แต่ถ้าจะจบก่อนภายใน 10 เดือนก็ไม่มีใครว่าอะไร) โดยจะต้องมีการทำสารนิพนธ์ (Dissertation) เพื่อจบหลักสูตรโดยจะต้องดำเนินการยื่นหัวข้อวิจัยพร้อมหาอาจารย์ที่ปรึกษาภายในเดือนธันวาคมนี้

เทอมนี้ผมลงเรียนวิชาทั้งสิ้น 5 วิชา ซึ่งล้วนแต่เป็นวิชาที่ผมเคยมีพื้นฐานมาบ้างตอนเรียนปริญญาตรีที่รามคำแหง ซึ่งวิชาที่เลือกได้แก่ Company Law, International Dispute Settlement, International Taxation Law, International Private Law และ Finance and Accounting

แม้ว่าผมจะเตรียมตัวมาบ้างในเรื่องภาษา แต่ปัญหาที่ผมประสบในสัปดาห์แรกของการเรียนก็คือ ระบบการเรียนที่ต้องช่วยเหลือตัวเองอย่างมาก ซึ่งทำให้ผมรู้สึกประหม่า

อันที่จริงผมก็พอได้ยินคำเตือนมาลางๆ บ้าง สำหรับระบบการเรียนประเทศยุโรป ที่มุ่งเน้นการศึกษาด้วยตนเองหรือทำวิจัยมากกว่าการเรียนในห้อง

ในฝั่งอเมริกานั้น แม้ว่าการเรียนในระดับบัณฑิตศึกษา นักศึกษาจะต้องช่วยเหลือตัวเองอย่างมากก็ตาม แต่ครูอาจารย์มีการกำหนดตารางการเรียนการสอนตามแผนการที่กำหนดไว้ นอกจากนี้ ครูอาจารย์ทางฝั่งอเมริกามักมีการจัดทำเว๊ปไซต์ที่มีข้อมูลการเรียนการสอนที่ครบครันที่อำนวยความสะดวกแก่ผู้เรียนในวิชานั้น ไม่ว่างานวิจัย ข้อมูลเพื่อทำรายงาน

แต่ไอ้ที่ผมเจอนี่ซิ การเรียนในแต่ละคาบที่กินเวลาสองชั่วโมง มีแผ่นใสมาฉายประมาณ 10 แผ่นเท่านั้น และแต่ละแผ่นก็มีเพียงหัวข้อใหญ่เท่านั้น (ใหญ่จริงๆ) ปราศจากรายละเอียดที่ช่วยให้เข้าใจเพิ่มขึ้น สิ่งที่เพิ่มเข้ามากลับเป็นเรื่องการแสดงความคิดเห็น และการศึกษาด้วยตนเองอย่างมาก

ลักษณะการเรียนดังกล่าวนี้ ในทางหลักการที่นี่เขาจะเน้นมาก ซึ่งเรียกว่า Problem Solving Approach ซึ่งนักศึกษาจะต้องทำงานหนักในแต่ละคาบในแต่ละสัปดาห์ เพราะเนื้อหาที่เรียนในแต่ละครั้งนั้นจะมีประเด็นให้คิดมากมายเหลือเกิน และเมื่อจบในแต่ละคาบ อาจารย์ผู้บรรยายจะให้การบ้านมาทำอีกด้วยทุกครั้งเพื่อศึกษาเพิ่มเติมด้วยตนเอง ซึ่งการบ้านก็มักมีเนื้อหาที่เกินเลยจากที่สอนทุกครั้งไป

สิ่งที่น่าสนใจก็คือ แม้การเรียนลักษณะดังกล่าวจะถูกมองว่าอาจารย์ไม่ต้องทำงานหนักเพื่อเตรียมการเรียนการสอน แต่การเรียนในลักษณะครูผู้สอนจะต้องมีความรู้ที่หนาแน่นพอที่จะตอบข้อสงสัยของเหล่านักเรียน (โข่ง) ที่ช่างซักช่างถามตามมาตรฐานของคนตะวันตก และพร้อมเสมอที่จะตอบคำถามในทุกขณะ การเรียนระบบนี้จะมุ่งความสำคัญไปยังตัวผู้เรียนเป็นหลัก และเน้นกระบวนวิธีคิดมากกว่าผลถูกผิดในลักษณะฟันธงเหมือนกับที่ผมเคยเรียนมาในระดับปริญญาตรี

จากที่ผมนั่งเรียนมาระยะหนึ่ง ผมพบว่าวัฒนธรรมการเรียนมีความสัมพันธ์กับการจัดรูปแบบการเรียนการสอนอย่างมาก

ผมพบว่านักศึกษาจากชาติตะวันตกมีวัฒนธรรมการซักถาม และโต้แย้งอย่างเต็มเปี่ยมและน่าชื่นชม ในขณะที่นักศึกษาจากประเทศฝั่งตะวันออกมักไม่แสดงออกเท่า และอายที่จะซักถามและโต้แย้งในห้อง

มีอยู่วิชาหนึ่งคือ วิชา Dispute Settlement ที่อาจารย์ถึงกับกระตุ้นให้นักศึกษาโดยเฉพาะที่มาจากฝั่งเอเชีย (จีน อินโนนีเซีย และกะเหรี่ยงไทย) พยายามแสดงความเห็นและโต้แย้ง เนื่องจากเงียบเป็นเป่าสากกันทั้งหมด

สิ่งที่อาจารย์ Noortmann พูดนั้นน่าคิดครับ ท่านได้บอกว่า ปัญหาของคนเอเชียก็คือความไม่กล้าแสดงความคิดเห็นซึ่งถูกปลูกฝังมาแต่เด็ก นักกฎหมายในประเทศกำลังพัฒนาส่วนมากจึงมักคิดว่าตนเองด้อยกว่านักกฎหมายที่มาจากประเทศตะวันตก ดังนั้นเมื่อมีปัญหาข้อพิพาทระหว่างประเทศ ประเทศกำลังพัฒนาจึงมักเลือกว่าจ้างนักกฎหมายจากชาติตะวันตกเพื่อสู้คดีโดยที่ไม่เปิดโอกาสนักกฎหมายชาติตนเองเข้ามาว่าคดี ประเทศชาติจึงต้องสูญเสียรายได้เป็นจำนวนมากให้แก่นักกฎหมายต่างชาติ โดยที่ไม่เปิดโอกาสให้นักกฎหมายชาติตนเองเข้ามาร่วมแก้ไปปัญหาเท่าที่ควร ดังนั้นการลองผิดลองถูกเป็นสิ่งจำเป็นที่จะทำให้เกิดประสบการณ์และการพัฒนาบุคคลกรในระยะยาว.......

ผมว่าสิ่งที่อาจารย์ Noortmann พูด คงเป็นลักษณะร่วมกันของคนในประเทศเอเชียส่วนมาก ดังนั้นผมว่า ก่อนที่เราจะไปต่อสู้กับฝรั่งในทางความคิด หรือในเวทีเจรจาใดๆ ก็ตาม สิ่งที่เราต้องพัฒนาอย่างแรกก็คือ ทำอย่างไรเพื่อให้คนของเรามีวัฒนธรรมของการวิพากษ์วิจารณ์ที่กว้างขวางกว่านี้ และกล้าที่จะเป็นตัวของตัวเองโดยไม่คิดว่าฝรั่งดีกว่าในทุกเรื่อง

ผมอยู่ในเมืองร็อตเตอร์ดัมแห่งนี้มาเกือบ 1 สัปดาห์แล้ว

ผมยังไม่ได้อัพบล็อค ไม่ใช่ว่าขี้เกียจนะครับ แต่ผมต้องมีหลายเรื่องต้องทำ ต้องจัดการไม่ว่าเรื่องที่พัก การเดินทาง อาหารการกิน ติดต่อทำเอกสารด้านเอกสารเพื่อขอใบอนุญาตอยู่อาศัย (residence permit) เหมือนต้องมาเริ่มต้นชีวิตใหม่ทีเดียว

ผมว่ามาเรียนในประเทศเนเธอร์แลนด์นี้อะไรก็ดี ไปไหนมาไหนสะดวก แต่เสียอย่างเดียวทุกหนทุกแห่งมีแต่ภาษาดัชต์ โดยเฉพาะชื่อสถานที่ ถนนหนทางที่มีแต่ภาษาดัชต์ ซึ่งอ่านยากมาก แต่ถ้าสงสัยอะไร ก็สามารถพูดคุยเป็นภาษาอังกฤษกับคนดัชต์ (สาวๆ) ได้เกือบทุกคน เพราะเท่าที่ผมทราบ คนยุโรปทั่วไป ยกเว้นฝรั่งเศส จะสามารถใช้ภาษาอังกฤษได้ดี และคนเนเธอร์แลนด์จะมีชื่อว่าใช้ภาษาอังกฤษได้ดีที่สุดเมื่อเทียบกับคนยุโรปชาติอื่นๆ

นอกเหนือจากอุปสรรคภาษาแล้ว อุปสรรคอีกประการหนึ่งก็คือ การทำความเข้าใจระบบขนส่งมวลชนในประเทศนี้ ซึ่งมีหลายรูปแบบให้เลือกใช้บริการ ตั้งแต่รถแท็กซี่ รถราง จักรยาน และเดิน

การใช้บริการขนส่งมวลชน สิ่งสำคัญอย่างแรกก็คือ ต้องตรงต่อเวลามาก เพราะรถจะมาตามเวลา ถ้ามาช้า ก็จะมีการแจ้งล่วงหน้าที่ป้ายว่าจะล่าช้ากี่นาที แต่ถ้าเรามาช้า รถจะแล่นไปโดยไม่รอเราเลย (จำไว้) :/

ผมเองเมื่อมาครั้งแรก งงเป็นไก่ตาแตกทีเดียว

ไม่เพียงแต่ชื่อป้ายสถานที่ต่างๆ ที่ล้วนแต่เป็นภาษาดัชต์ พอหาเส้นทางที่เจอแล้ว ก็ต้องดูตารางเวลาเดินรถ หลังจากนั้นก็ต้องเลือกราคา

ในประเทศเนเธอร์แลนด์นี้ รถไฟที่เชื่อมโยงระหว่างเมือง (intercity) มีรถไฟให้เลือกใช้บริการหลายระดับราคา ขึ้นอยู่กับเป็นชั้นหนึ่ง หรือชั้นสอง ซื้อแบบไปกลับหรือซื้อแบบเดินทางขาเดียว และจะเอารถที่แวะทุกสถานีหรือเฉพาะสถานีใหญ่ๆ เท่านั้น

ลองคิดเล่นๆ นะครับว่าคน (กะเหรี่ยงไทย) ที่เพิ่งเดินทางมาถึงครั้งแรก จะงงกับข้อมูลจำนวนมากเหล่านี้ และจะตัดสินใจอย่างไรไม่ให้ผิดพลาด แน่นอนครับ มาวันแรก ผมหลง และคลาดเวลาจากที่นัดหมายกับพี่คนไทยไปเกือบ 2 ชั่วโมง และด้วยความที่เป็นห่วงว่าพี่คนนั้นจะหายอันตรธานจากจุดที่นัดไว้ ผมจึงรีบเร่งรุดกึ่งเดินกึ่งวิ่งกับสัมภาระเกือบ 30 กิโลกรัมไปยังที่นัดหมาย .....

ปรากฏว่าพี่คนนั้นยังอยู่อย่างสบายอารมณ์ .....

เหตุผลหรือครับ พี่บอกเหมือนรู้ว่ายังไงก็ต้องหลง เพราะเขาก็หลงมาก่อนเหมือนกัน (ฮา)

หลังจากนั้นเป็นต้นมา ผมจึงต้องทำการบ้านเพิ่มเรื่องการเดินทาง เพราะผมเองก็ต้องมีภารกิจที่ต้องทำหลายเรื่องที่มหาวิทยาลัย การเดินทางด้วยรถรางเป็นสิ่งจำเป็น จะให้เดินด้วยเท้าอย่างเดียว ก็เกรงใจ..... หลังจากเชี่ยวชาญเส้นทางแล้ว ก็กะว่าจะซื้อจักรยานเป็นพาหนะในการเดินทางซักหน่อย เพราะคิดแล้วคงคุ้มกับการลงทุนในระยะยาว

อาทิตย์หน้านี้ผมจะเปิดเทอมแล้ว ไว้ผมจะกลับมาอัพบล็อคเกี่ยวกับการเรียน และเรื่องสนุกๆ เกี่ยวกับนักเรียนไทยที่นี่ ให้รับทราบนะครับ

ผมเป็นคนหนึ่งที่ได้รู้จักชุมชนชาวบล็อคมาได้เกือบ 3 เดือนแล้ว

ผมเป็นคนหนึ่งที่ได้เห็นการเติบโตอย่างรวดเร็วของชุมชนแห่งนี้

นอกเหนือจากการเติบโตของเครือข่ายชุมชนในแง่จำนวนคนที่เข้าร่วมแล้ว

สิ่งที่ผมเห็นว่าสำคัญยิ่งกว่าก็คือ สมาชิกมีการแลกเปลี่ยนความคิดเห็นที่มีประโยชน์

ไม่ว่าเรื่องส่วนตัวในมุมแคบ หรือสังคมในวงกว้าง........

ในระยะเวลาอันใกล้นี้ ผมเองก็กำลังจะเดินทางไปศึกษาต่อยังต่างประเทศ

ผมไม่ได้คาดหวังว่าบล็อคของผมนี้จะให้สาระอะไรมากนัก

แต่ผมอยากจะบันทึกความนึกคิด และประสบการณ์การเรียนกฎหมายในประเทศเนเธอร์แลนด์ของลูกผู้ชายคนหนึ่ง และความเป็นไปของนักเรียน นักศึกษาไทยในประเทศกังหันสีส้มแห่งนี้

โดยเฉพาะอย่างยิ่ง สำหรับคนที่สนใจไปศึกษาวิชาการด้านเศรษฐศาสตร์ และกฎหมายในกลุ่มประเทศยุโรป นอกเหนือไปจากประเทศกระแสหลักอย่างอังกฤษ ฝรั่งเศส หรือเยอรมัน ที่คนไทยมักเลือกไปเรียน เพราะในประเทศเนเธอร์แลนด์นี้....

1. มีโรงเรียนเศรษฐศาสตร์ชั้นดี ที่เคยมีนักเศรษฐศาสตร์โนเบลอย่าง Jan Tinbergen แห่ง Erasmus university มาแล้ว และยังเป็นอาจารย์ที่ปรึกษาวิทยานิพนธ์ของ ดร. ศุภชัย พานิชภักดิ์ ซึ่งเป็นศิษย์เก่าสถาบันแห่งนี้และเป็นผู้อำนวยการองค์การค้าโลกคนปัจจุบันอีกด้วย

2. มีโรงเรียนกฎหมายที่เก่าแก่อายุมากกว่า 500 ปี เช่น Utrech university , Groningen University และเป็นตักศิลาชุมนุมของนักกฎหมายที่สำคัญแห่งหนึ่งในยุโรป เพราะไม่เพียงแต่เป็นที่ตั้งของศาลโลกแล้ว ประเทศเนเธอร์แลนด์ยังมีสำนักพิมพ์ด้านกฎหมายที่เลื่องชื่อแห่งหนึ่งในโลกด้วย นั่นคือ Kluwer Law International ที่มีการตีพิมพ์งานวิชาการด้านกฎหมายที่มีคุณภาพมาอย่างยาวนานและต่อเนื่อง (และแสนแพง)และที่สำคัญ ประเทศเนเธอร์แลนด์ ยังเป็นประเทศหนึ่งในยุโรปที่มีกฎหมายที่มีเนื่อหาสาระในด้านสิทธิพลเมืองที่เสรีมากแห่งหนึ่งในโลก ไม่ว่ายาเสพติดถูกกฎหมาย โสเภณีถูกกฎหมาย หรือแม้กระทั่งกฎหมายการุณยฆาต (Moral Death) อีกด้วย........
